    You are reading my post selectively and not in its entirety. I did not say EAD is waste and useless, I said EAD is waste and useless without the removal of semilar or same job requirement in AC21 as USCIS will sooner or later deny AOS based on semilar\same job requirement. Do you know how many RFE\denial notices have been issued by USCIS to EAD\Ac21 workers? There is an entire thread running into several pages related to that. Scores of people wrote to USCIS ombudsman complaining about USCIS issuing denial notice to people whose I140 was revoked by previous employer even though Ac21 says AOS continues even if I140 is rovoked by previous employer. There are instances where USCIS has issued rfe to prove they are in a same\semilar job. History has shown USCIS uses issues like same\semilar job to kick people out. Based on the IO adjudicating your case, based on the economic climate etc USCIS has made life difficuly (current h1b crackdown is a example).

    What I am saying is bring in protection to AOS by
    -removing the same or semilar job requirement in AC21
    -making sure USCIS does not deny AOS when previous employer revokes aproved i140.(even though ac21 says aos cannot be denied, USCIS is sending denail notice).


    Yes EAD is absolutely better than H1b but not for long, when people start using EAD instead of H1b, USCIS will start denying AOS based on Same\semilar job or other grey areas (not working on EAD because of lay off) then you are back to square one. If you are on EAD and AOS is denied you are out of status like H1b. Close the loopholes first before you open the pre filing AOS. Your statement regarding not work at all on EAD is not correct. USCIS can issue rfe\denial notice for lack of job. I hope it was true that it does not matter if you are not working at all on EAD.




    I read through your reply, however, I found it extremely hard for me to accept your points. You've been probably on EAD too long to remember what a dire condition you came from as an H1B worker. Let's look at it:

    As an AOS, you can:
    - Work for any employer
    - Not work at all
    - Travel out of the country without worrying visa delay
    - When you got laid off, no need to worry about being out of status or restarting GC

    As an H1B worker:
    - If you are laid off, everything, years of wait, thousands of dollars, down the drain, and the whole family becomes out of status immediately. And in this dire economy, this is a sword hanging on the head of every H1B worker.
    - Worry about re-entry visa each time you travel

    With such a huge different, I can hardly convience myself that EAD is 'useless' or 'waste'. True, you'll need to work for same or similar job, but compared to the benefit, it is not nearly as big a problem faced by H1B workers day by day.

People with 07 PD has the privilege to cheer when they cut in front of us, but we should not feel sad for being pushed back because it is a disruptive behavior.

    Please do not list what you have done to add items in the legislation to help BEC victims, it does not look genuine any more when it is considered disruptive to express one's depression on a board specially for BEC victims.

    It's true that Democrats tend to be pro immigrants a bit. However, most of their backers are labor unions, which obviously don't want to see any more labor here, legal or illegal.

    How will these forces play out on the floor is anybody's guess. We've seen how a Republican congress works. Let's see how a democratic congress will. I'm just a little bit hopeful... same as 12 monts ago... not more... not less.

    Just a simple question. Corporations are arguing that every year 100k new jobs are created in high tech. Even 75% of the new jobs are for H1b then only 75k H1bs are needed. Even if you include other jobs teacher,Healthcare you do not need more than 120K every year Why do you need unlimited H1bs? Any pro immigrant lobbying group is not giving justification in numbers though everyone accepts there should be increase in H1b numbers.There should be increase in GC numbers as backlog had increased(But in this case also no one gave correct numbers based on requirement) but nothing wrong in H1b quota and some regulations in H1b to minimise abuse.

    Another aspect is in the bill they gave 115k H1b for 2008. If they do not put restrictions your company cannot get any new H1b as most of H1b quota will be used by Indian consulting companies in one day. Do you think it is correct?
    If not correct what is your solution? Corporation solution for this problem is unlimited H1bs by giving exemption to STEM and US master degree holders from H1b quota.

    I am also opposing the restrictions in H1b program in the bill. But I do not have any alternative solution for the problems in the H1b program.


    Again, there is a common misconception that companies have unlimited access to talent in other countries, and the only limiting factor is the quota of H1B visas.
    Not true, by a long shot.
    To give a simple example, our company is looking for people in Australia, Denmark, Finland, Canada and UK since the pool of qualified people in India has dried up in our field. Can anyone guess where is the biggest talent pool? Nope, not in Bangalore, its right here in USA!! Not all companies are looking for the cheapest person. They are looking for the best person. And in many cases, the best person is already here, and has gathered more experience over the years working for US companies. But they cannot hire her, simply because she is on a visa and thereby beholden to another company. If she had a GC, that would free up the talent pool and thereby make many companies less reliant on H1Bs. Increasing GCs for EB candidates has the same effect as increasing H1 quota, with the added benefit of making the cream of the crop available and reducing the uncertainty and hassle of hiring an H1.
    This is why it is in the best interest of companies to support EB GCs.
    My friend Senthil makes the same mistakes (repeatedly, unfortunately):
    (A) Assuming that "good" companies will not be affected by any change of increase in fees for H1B, since they presumably have unlimited pockets and unlimited access to unlimited talent. (Big ha!ha!)
    (B) "Good" companies can always get to hire people in US if they exist, and the only reason they hire H1 is that they cannot find anyone in US as there is no one in US who is good enough for the job for love or money (Bigger ha!ha!)
    As to the question "then why are companies not doing enough for EB candidates", I do not know, and neither does anyone know, truthfully. Maybe they are, but as someone pointed out, no single player in the CIR game has enough clout to run the whole show. Or else the bill would have been passed long ago.

    Some of the core members are also stuck in BEC. But they still worked selfleshly. And don't preach injustice to me, I came here to study in 1999, got one labor (PD 2002) rejected on technical grounds, went in for other labor PD 2005, so my situation is probably worse than you.
    Are you the guy who came up with a stupid idea of creating an entire thread for banning people? You probably don't even know the definition of Freedom and Injustice and you say you studied in US (did you pass?). and hey my earlier post was not a response to you.

    A canadian citizen does not have to leave this country. But if your family members are not canadian citizens then they should leave. Also a canadian citizen can get a TN visa and work in US.
    Instead you could just stay here till you get a similar job, and apply for 485 when visa numbers are available.
    You should ask your company to not withdraw your petition.

    I wanted to attend but I have pretty much exhausted all my vacation. 2 more days will be pushing it.

    Also, the flight schedules to fly from Portland Oregon to D.C is so ridiculous that it takes a whole day away in flying.

    Will definetely attend a rally in the east coast, or better yet will help organize one.

    Are you kidding me? Everyone and his friend applies for an EB-3, people who can barely program 2 lines in a computer or do any other meaningful task, will qualify in EB-3.

    Isn't there a minimum qualification/education requirement for EB3?

    No. What I am saying is that this is a good amendment that can help us. But if its introduced and voted upon, it will fail to pass in the Senate because this amendment has a H1B exemption and H1B quota increases are very very unpopular and controvertial since last few years.

    Therefore the achilles heel (Weak portion that will cause failure) of this good amendment is the H1B quota trick attached at the end. The amendment may pass the senate with a majority vote if it doesnt have H1B quota exemptions in it.

    logiclife , you may know more, being close to or part of the core group, about how these processes are going. But from my observation , I think these bills get passed or failed based on lobbying (apart from legislators political considerations) , even though those provisions may not be fair to all. consider why a sweeping change like amnesty(what ever you name it) to illegals is being voted in, while legals are made to stand in line forever.

    I think it will have better chances if H1 provisions are included because of a broader industry lobbyists that support H1 program. They do not support GC backlog elimination as much as they love getting more H1s.

    Who do you think will push for a bill that has only all good things for EB GC applications ? I am not questioning your reasoning, I just want to know :)

    As some one put it, " But for the bad luck, we would not have a luck". This immigration issue is being discussed because of undocumented workers and their group's push.

    We cannot compare EB and point system now. Only point system comes we will know the problems

    But there are problems with the point system that have been foreseen and articulated right before it starts. Compare that with the EB system which has sound underlying principles and has worked fairly well. The backlogs and process delays in the EB system have resulted from

    1. A lack of funding for past legalization initiatives (245(i) amnesties) AND
    2. A lack of employment based green card numbers AND
    3. The 7% country quota

    The point system proposed in the CIR system does not address any of these 3 points, plus it is not spelt out how they would deal with the situation where a few countries submit greater than 10% of the applications with high points (what we call retrogression today).

    Please check with your lawyer but as per my understanding, your wife needs to be in 'status' to be added as a dependent on the 485. Since she is on H1B, she is already in 'status'. There is a separate thread for documents required for 485. Check there.


    Hi folks,

    My labor and 140 got approved and PD is march 05.
    After the good news, I can apply for 485, But I have
    a question. My wife she came on H4 here and then converted
    to H1B and get stamped also. Is it going to be a problem if I apply 485 for
    her ( because of H1B) and if its not a problem guide me what are the necessary documents
    for her.

    This is the brazen post I was talking about earlier. Even MC himself acknowledges that this post is "unhelpful", and he is deliberately doing this. This gives a negative impression of how serious this person is. I would urge him to buck up and learn to work with everyone, and quit watching "balance" from his sole viewpoint



    This is an "us vs them" argument. Not upto the standard desirable from IV point of view



    Understand the realities here: IV is struggling to make even the most legitimate views heard and you are sitting and talking away as if USCIS and lawmakers are your servant. Go for the ONE thing to wish for that will solve all troubles, because you have only one chance.



    Good dialogue. Ironic how it applies to so many posts here arguing in the opposite direction
