When a particular priority date becomes current in the next month's bulletin,say the July bulletin. Does USCIS start looking at the current cases once the July bulletin is issued or starts looking at them from July 1st.

Yet another update to the H-1B quota, also known as the Fiscal Year (FY) 2011 H-1B cap.
Approximately 34,900 cases have been receipted by USCIS for the regular Bachelor's degree H-1B quota.
Approximately 13,000 cases have been receipted by USCIS for the advanced degree H-1B quota open to applicants who have earned Master's or higher degrees from US colleges and universities.

Based on USCIS's last action rule, the status of an applicant depends on whatever petition is approved last. So, if her H4 is approved after her H1 COS, then she will be on H4.
I am assuming you have applied for H1/H4 extension recently in regular processing. So the chances of her H1 COS getting approved first under premium are higher. So once you get her H1 COS approval, just withdraw her H4 petition.

Perhaps there is a chance we'll see some action on the DREAM Act in 2011 albeit with some major tough to accept changes. The key areas likely to change are the education requirement (mandating actually receiving a degree versus simply attending school), the ability to sponsor relatives down the road when DREAM Act finally become citizens (at least 13 years out) and criminal bars on applying.

United States Citizenship and Immigration Services (USCIS) released an updated H-1B cap count of 45,100 as of August 28, 2009. This reflects an increase of 100 cases from the prior count, provided on August 14, 2009. The advanced-degree cap remains at 20,000. The USCIS continues to accept FY2010 H1B cases under the advanced-degree and regular caps.
We suggest to US employers to file H-1B Petitions only if they can able to provide the Client details like Letter from the end-client, Work-orders confirming the placement. If you are having an in-house requirement, provide USCIS with ample proof of your in-house requirements. Considering the flood of H-1B RFEs, we have to be bit cautious in filing works. The standard approach prevailing until last year needs a re-look. Be assured, if you are right on papers and abide the Immigration requirement, you will for sure come with flying colors. We will be happy to help and support you in H-1B and other filings. It is widely believed that the H-1B Cap will be available even after Sept. 30, 2009.

Hello,
I joined and contributed already to the IV although I am not yet on the GC queue. I support you all with my heart.
I have a different concern about PERM filing. My application will be EB2 with Ms + 4 years as Senior Soft Eng, and my lawyer asked my manager to create the business necessity letter for MS degree. He is not experienced with this kind of paperwork and the lawyer seems to be just not helpful rather demanding... I was wondering if somebody in IV had to deal with this business necessity letter. Any information would be helpful...

Hi All
My wife changed her status from F2 to F1 and recently she went to India, so she had her visa stamping appointment on Feb 18. at the counter the visa officer told her that she hasnt paid the SEVIS fee so has to go outside and pay online and come back with the receipt. she did and went back and she was told that she has got the visa and the passport will be mailed to her. she hasnt received it yet (its about 8 working days now), and when i contacted the consulate they replied: "We have provided a pink sheet, which says that the SEVIS is not updated in the system. Once it gets updated the passport will be sent to the mailing address."
1. is this delay a normal occurance and how long it takes in such case?
2. do you guys see any problem in this case?
please advice..

Hi,
I had an approved I-140 from my previous company with a priority date of Nov 2005. I moved to a new company, and my GC was applied again in Dec 2006. My previous I-140 was used to retain my priority date. However, my new I-140 from this company shows the priority date of Dec 2006.
How do I make sure that my previous priority date (Nov 2005) is on file, and my case will be filed according to that.
