    Hi,

    My employer filed H1B transfer in Feb 2009. however he could not receive RFE letter with in time on mail and only received after RFE submitted date was expired which is May 25th, 2009

    In jun1 1st week , he filed for the RFE extension for the stated reason and also refiled H1B to make sure that I should be in valid H1B status in case of first H1B denial in mean time

    Employer submitted all the documents related to RFE on June 20th and it got approved on jul 1st.

    What are the best options for H1B refiling case

    in case if it is denied, will it super impose the original H1B approval ?

    is it good idea to cancel/revoke pending H1B refiling case ?

    Hi
    I am working on Windows 7 based application development in Silverlight. I have not been able to find a way to play a an audio file in windows 7 phone. I have been googling it since past few days but i could not get any solution of that. There is a class in C# with name SoundPlayer but i guess its not available in Windows 7 Phone.
    Can anyone please help?

    Hello,

    I am sure others might have noticed that 485 processing dates at NSC (for example) have literally crawled from the beginning of the year to now. Here are the processing dates (per USCIS status).

    12/15/2007 Status - 04/24/2007
    01/15/2008 - 07/19/2007
    06/15/2008 - 07/28/2008

    Thats roughly 9/10 days worth of 485 processing from mid-Jan to mid-Jun 2008. I wonder what the processing date looks like for the mid-July status update (which should probably be out tomorrow).

    I am currently working for Company A on h1b, expiring on May 31st 2010. The GC application is denied based on on A2p issue with company A.

    I had company B already filed for my labor in 2008 and approved in Jan 2009. They also filed concurrent 140 and 485 in March 2009 which is still pending. Company B wanted to hire me and now its time that I move to company B. I do have latest paystubs from Company A, currently valid i797 and experience letter.

    can I migrate to company B by transfering my h1b based on approved labor with company b and pending GC application. What documents are required to transfer.

    Gurus,

    To all those who have received the FP notices,are your I-485 dates current for Processing ? or you have received these notices after the lapsing of the earlier FP ??

    I have done one FP initially when my Case was filed.Its been long since the validity of that FP has lapsed. Should i be expecting another FP notice??
    Is fresh FP notice being sent to all those whose FP validity has expired? or are they doing that in a random manner ??

    I am in H1B visa (valid until 10/2011), my wife is in F1 student (valid until 8/2011). We just got married 1 month ago in US. currently, we are staying in US. Now, she would like to stop studying for some reasons. To keep her valid stay in US, I have to transfer her f1 to h4. Could you please let me know step by step what I should do, what form I should take…etc.

    Does she need any visa interview after filing the transferring f1 to H4?

    Can she inform the school that she will stop studying right after filing visa transferring? (the school will stop her f1 if they know that).

    Visitor's visa for my parents expired recently (it was a 5 yr VISA & they visited here 3 times and returned within 6 months each time) and they want to re-apply for a visa. My question is - Do I still need to send in the Document of Support, Employer and Bank letter or they can re-apply without these documents? On the safer side, I am sending the documents but in my view there should not be a need for the support documents...Anyone in similar boat?

    Hi,
    My H1visa expirs on Aug 2009.I am travelling to india this month and be back at the end of May09.I have EAD and AP in my hand and valid till next year.
    After I come back I want to change my employer using EAD in the month of July09.

    1.While return back which one I have to show at POE? H1 or EAD?
    2.If I show H1 I will get I94 card only till Aug09.So later If Ichange to EAD will it be problem?
    3.If I show AP at the POE, my status legally changes to Parole.So can I continue till Jun09 with my current employer on H1? Because I don't want to change to EAD with my current employer as I am getting offer in July09 from new employer.
    4.I am planning to add my spouse to my GC status after I come back.He is on H1B right now.What are the impacts if I migrate to EAD?

    Can you please respond back immediately.Thanks a lot.

    Guys I will be going for my first H1 visa stamping in New Delhi. I am currently in the US. I transfered from F1 to H1. Have been looking into documents to take to the interview, and looking at so many 221(g) cases, have been confused by this term "unemployment wage report". I would really appreciate it very much if someone could please tell me what is "unemployment wage report" and how is different then "prevailing wage report"? Also, do I need to take both of them to the visa interview? Thanks!

    I have these below queries on Green card processing

    My Green card processing background
    My labor and I140 are approved and have priority date of May 2006 under EB3 category.

    The reason for these questions is that I am planning to change the company that I am working with.

    Questions.
    1. Can I port the priority date (March 2006) when applying for new green card with new employer.
    2. If possible to port the priority date can I apply under EB2 category assuming all other criteria satisfy for EB2 category and use the same (May 2006) priority date.

    My company is filing 140 and 485 on a preapproved LC (PD of 2005)

    But my original LC in P-BEC just got cleared (PD of 2003). They told that they will also use my original LC for 140 as this gives better chance than the substituted one.

    1)How Can I have 2 140's ?

    3)How will it effect 485?

    I'm confused ..please answer
