I am EB-3 ROW PD 2007 Aug. Reading all the Eb-3 I people's angry, I started to wonder what's gonna happen to the EB-3 ROW. Seems like if lots of Eb3-I change to EB2-I , They will probably eat up all the Spillover from Eb1, EB2 ROW from now on. That makes EB-3 ROW and EB-3 I become the same boat.
Is it what gonna happened? and think about how many people can afford to spend an extra 10k to change the status from EB-3 to EB-2? That's totally not fair. We need to take action all EB-3 ers!!!!!!

i do not think its' quite that bad for EB3 ROW. the spillover system now in use is what USCIS was already doing till 2005. only in 2006 did the vertical spillover have any impact, since 2007 numbers were skewed by July. so things really have not changed that much for EB3 ROW. they will still get the large bulk of EB3 GC numbers, while retrogressed nations are limited to 7%.
also i do not think every future filing can be EB2. as it is USCIS a DOL appear to have tightened their scrutiny and narrowed their interpretation for both EB1 and EB2 approvals.

u cannot roll into a roth directly. u have to roll into a regular ira and then to a roth.
but the earlier statement made sense.. dont withdraw immidiately..wait till the next yr and then withdraw from ira..so ur taxes will be 10% penalty and ur tax rate at that time...which will depend on the value of ur 401k.
so if make 80k now and are in the 25% bracket and u have 80k in 401k then u ll have to pay taxes equivalent to the 25% bracket.
but if u make 80k and have 20k in 401k then u r bracket will be the lowest one.

Can you give us some more details about the call to get receipt number?
One of my friend called but they said they can only give I-140 Receipt no to employer.
I called USCIS today and they asked my name and date of birth and they gave me my Receipt Number for I-140.
My I-140 was recieved on July 16th and they generated a receipt notice and have sent me...I shud probably recieve it by this week.
Hope u all also get it soon...

The original bill had a 10% per country cap. Don't think that has been removed in the new bill.

Hi all,
First I thank IV core team for making the D.C rally a big success.
Here are few of my thouts.
1)To get more chinese and other foreign nationals involved in our team we better to put active chinese and other nationals in IV core team (Its just my idea and if you think its not a good one please ignore it.)
2) Yes we better do a second rally but at thesame time we better to educate them first by giving adevrtisements and things like that.

I would love to attend the rally. However my financial condition at this time does not permit me. I could have booked a ticket on my credit card but all my cards are max out!
You want to know why I am in this financial deep hole? Well, I have two sons in college and paying out of state tuition, that is over $17,000 per semester for both of them.
My wife on H4 could not work until now that she has an EAD. It is retrogression that I should blame and I would love to do all in my power to obtain relief or bring the issue to the attention of the American public.
In my own way I have contributed to IV both in cash and in kind. I have told me story in countless media interviews. I only wish I could do more for IV financially but alas I am not able to do that at this time.
I would be in the rally in spirit....only I wish I could attend in person.
Please share what's on your mind! What is preventing you from wanting to attend? What will it take to change your mind? A lot of us are willing to work with you, donate money, transportation, housing, etc to get you to attend! Let us know and we will help make your trip easy, painless and even free. In my opinion, with this global economy - if the spouse is well educated and can work, there should be an opportunity for that person to work (atleast few hours per day).
Excellent point. I think that the heart of the issue is that the immigration system in US is stuck in stone age when the needs of a knowledge driven, global economy are considered. Every visa category denied a job is seen as having an American having a shot at that opportunity. This is a short sighted view: people that can be launching companies etc are sitting and waiting for a decision from an inefficient, ineffective and outdated bureaucracy.

First of all I think logiclife will go in the history of immigration books as the movers that existed in this generation. I am amazed at how motivated the IV core team is and how smoothly they have organized the whole show so far.
I salute you. Hats off to you guys.
I read a lot of newspaper articles after the rally and they always seemed to mention that Indian and Chinese legal aliens protesting backlogs. I think there should be some effort to also include people from other nationalities such as Russians, Englishmen, Philipinos, Chinese and other nationalities. Now I know they are not hit as hard as us but they go thru some serious backlog as well if they are in the EB3 category.
Question is I am thinking how?
Any ideas guys?

Its funny how some so called indian "newspapers" like siliconIndia are very religious to echo the "statements" and "Sentiments" of these people from other countries. Again, this article states "it is said...bla bla", they are talking as though it has become an epidemic and all the billion plus people from India are gonna follow to their greener pastures. Yes, these countries can do what they need and can do, but for God's sake, dont paint a sorry a$$ picture. They jsut continue to show how ignorant and foolish they are :)

And this new caste system of the DONOR forum which basically says screw you to everyone who has spent time, money or effort on IV and completely goes against the "Change for fairness and Justice" mumbo jumbo is a step in the right direction, IV needs to give way to an actual movement that actually does something and this DONOR forum concept will certainly go a long way in the marginalization of this site and community.
I completely understand what chaanakya is saying and I have a similar opinion. I understand the concept of "Donor" form and it exclusivity of information if you donate. If I question about the concept, I know I will be put down and if IV wants to move in that direction to reach the goals then so be it. So let me spare you from typing anything against my opinion. Change always takes time. Being in DC and visiting lawmakers was an incredible crash course for me in the practicalities of American politics. It was fascinating. I have to say it was one of the most satisfying things I've ever done in my life.
Whilst we are pushing for rapid changes, the realties are that building the type of relationships that we were doing in DC can take time to foster change

Change always takes time. Being in DC and visiting lawmakers was an incredible crash course for me in the practicalities of American politics. It was fascinating. I have to say it was one of the most satisfying things I've ever done in my life.
Whilst we are pushing for rapid changes, the realties are that building the type of relationships that we were doing in DC can take time to foster change
Anyway - lets close the thread. I was hoping to get some better information about how we can improve our motivation techniques for the future. I got many answers...

My Mother in law is severely sick, and my wife needs to travel asap. We need to get her AP, as it's expired.
1. Is there an urgent processing option for the AP? And how ?
2. Can she travel on the receipt of application, and I can send the AP document to her by FEDEX?

Just go to the USCIS office even if you do not get an infopass. Go with I-485 receipt, 2 passport size photos. If you go first thing in the morning, you might be able to get the AP issued to you the same day. MAKE SURE YOU TAKE A LETTER FROM THE HOSPITAL/DOCTOR STATING HER CONDITION. It can be a faxed copy.

Other companies/coalitions have stopped pushing for temporary H-1B increase as they do not want to be in the bad books of committee chairmen and the leadership offices by trying to sneak temporary relief that divides the supporters of CIR. Leadership wants support for CIR and want all sides to wait for CIR. And not doing so and trying to get interim relief before CIR would put them in bad books of Senate and House leadership, which no one wants coz if CIR fails, then after CIR, these offices will not co-operate with any group that tried to take away support from CIR. I don't want to oppose IV, but think it this way.. If Microsoft and many big companies asking an increase in H1-B for so many years did not get anything done since 2005, then what are our chances of our voice even reaching them.
Everyone were so desparatly waiting for the I-485 relief before 15th feb.
Now that we know that the provisions and their language are decided much in advance, can we know if senate is really going to introduce CIR next month and are inclined towards passing it.
After reading the complete post, I have come to conclusion that we cannot
hope confidently that anything can pass this year or in the comming years.
