All the talk on the forums were about visa data movements only in the last quarter. So the one month movement for Eb2-I and Eb3-I is kinda expected and is not really a disappointing news.
The dates would move forward. Based on the discussions here, there are around 80,000 visas still available for this FY. (50,000 pending from regular EB quota + some 27,000 due to AC21 backlog + 2007 share from Family other quota). For the USCIS to not waste any more EB visas, the DOS will have to move the dates forward. I am expecting that Eb2-I will be set some where in 2005 and Eb3-I will be set at the middle or end of 2003 in the coming 3-4 months.
This month also didnt improve EB3 (I) condition!!
Does this mean more and more will convert to EB3 whose PD is 2001-2004?

i sent an email to Senate Lieberman about the gap between the old and new system and h-1b extension:-
You might be the only Senate who cares legal immigrants and our contribution to US economy and its future. Some immigration attorneys and legal immigrants find out that the current CIR bill draft ends the existing employer-sponsored immigration system well before the inauguration of the merit-based point system. (please refer to Sec. 502 (d) (2) under Title V � Immigration Benefits on page 264 and 265 of bill text (SA 1150). If the CIR bill was signed into law, some departments would take time to establish procedures and it might be YEARS away to get merit-based immigration system ready for accepting applications. But the bill already ends the employer-sponsored system on �the date of the introduction of the [Insert title of Act]�. Can you see the gap between the old and new systems? At the same time, extension of H-1B is not possible if the immigration application filing is less than 365 days under the merit-based system. (please refer to Sec. 419 (d) (1) on page 239). For those who are already at the second 3-year of H-1B, we would face very unfair situation if the CIR bill were enacted as it is now: filing under the employer-sponsored system were invalid but the merit-based point system were not ready to accept any application yet. Previous time elapses until the H-1b couldn�t be extended after the 6th year.
I suggest to keep the current employer-sponsored immigration system running (accept new employment-based applications and the filing during such period is valid) until the merit-based system is able to process any applications and to reduce the 365 days to 180 days in sec. 419 (d) (1). Are you saying the future greencard applicants will have to compete with lot more new H1b s?? Wouldn't this bill help alleviate the retrogression problem and those with approved LC, I-140 etc??
No. What I am saying is that this is a good amendment that can help us. But if its introduced and voted upon, it will fail to pass in the Senate because this amendment has a H1B exemption and H1B quota increases are very very unpopular and controvertial since last few years.
Therefore the achilles heel (Weak portion that will cause failure) of this good amendment is the H1B quota trick attached at the end. The amendment may pass the senate with a majority vote if it doesnt have H1B quota exemptions in it.

Its not over till its over :), and its not over yet by any means. I am willing to wait and fight ;) . Everyone has priorities in life, each person would view GC situation differently. For me, its not the ultimate dream, but just a vehicle to continue my journey for some more time (with peace of mind). I am definitely looking to gray my hair in my home country or atleast be there once I am grayed haired :D
Doing an MBA/PMI and looking for managerial job is the only realistic possibility for most, I don't think most people would wanna still be programming when they turn 40/45 (depending on how old/young you feel).
My gut feel is that there will be some kind of relief by end of 2007 or early 2008

No, it isn't NC and NC alone. The percentage of people that get stuck in NC is minuscule compared to the back log due to inefficiencies.

The fact remains, the USCIS is very far from effcient
I totally agree that USCIS is inefficient in using all the visas allocated. DOS provides cut-off dates based on the projection given by USCIS. USCIS always on the defensive and provide the cut-off dates that results in such waste in EB visas every year. I do not think that they are ready to learn from their mistakes, otherwise how come this is a regular issue every year? Even a small relief like using the entire visa allocated will be better in such retrogression.
I hope USCIS will be made liable for the mistakes done in their past and provide those unused visas back to EB.

Depends on the situation one is in .. May be they wont leave seeing this bulliten but may be forced to go back after a few more ..
What I dont understand is , is it really the case , all labours being approved in back log centers are really being used for original applicants .. I think very less percentage of them exist in those companys for so many years. If they do they should get VISAS.. but I doubt.
What happend to recently proposed to remove labour substitution? Does any one know.

I know i keep bumping this thread but I am surprised that no one has posted any experiences regarding the AP. I mean i see a TON of stuff about EAD renewals but nothing specifically about the AP. I guess ppl are more interested in making money than leaving the country (like ME ;) )

By AF. It was an OK experience, except for the fact that they loot you on the transit visa fee. Also CDG airport has got to be the busiest but one of the worst airports in Europe. My baggage landed in Mumbai instead of New Delhi, but was sent to me by courier in 2 days time.
Also don't ask a second time for the I-94 form, as the stewardess will frown and shove it in your face. :p
Next time I shall pony up the additional fare for Thai, Singapore or Malaysian and never flying a European route again.

I have been speaking to colleagues and friends. Not many were aware of the rally others didn't think it would make an impact.After I showed them the website and BBC news article they were listening. I was hesitant to come there now that i was there i will attend a 2nd, 3rd and everyone. People in different parts of the country should lobby and bring 20-30 people and then you'll see numbers. You will be fine as per the rules. Just make sure you hire a very capable and reputed attorney, just in case the one you have isnt the best. I faced something like this, with 140, and went to one of the big firms we quote many times here and the case was approved with an MTR in just 20 days.. DOnt loose heart. But make sure you do the documentation whatever is needed and make no compromises there. Provide more thats relevant.

Still waiting on I-485 denial notice.... its almost 13 days and haven't received it yet. My attorney called them and asked for FAX of denial notice.

Are uou IT manager or working in non IT field. If you are in IT and non manager then doors are closed for you to go to Canada.
If you have plans of doing an MBA in future, then Canada would be a better option than US. Otherwise as uma001 points out, doors are closed for most professions except 38 occupations.
