Even if you were current what is the guarantee to that you will get your GC soon.

Hello,
My wife changed her status from H4 to F-1 while in USA. Now due to family situation, she wants to travel to India. She is on OPT now and working for an IT company since Apr 10.
She will be going for her first F-1 stamping. I know it is risky to go for F-1 stamping while on OPT.
a) What are her chances of get F-1 stamping?
b) What measures should we take that will increase her chances ?
If any body had similar expeince please share here.
Attorneys or any one please guide us in this regard.

Hi,
I am currently on H1b and had recently filed papers for transfer from employer A to employer B. I have got the email from USCIS that my case has been approved and that documents will be delivered soon.
My H1b transfer has been accepted for 01/01/2010. My date of joining the new job is 01/04/2010. My original H1b with company A is still valid till Oct 2009.
Since I have to give my old employer a two weeks notice to resign. If I give my notice around 12/21/2009 (notice period of leaving by 01/04/2010) and my employer relieves (terminates) me immediately will I be out of status at any time?
Also, My green card process is going to start soon. Is it going to affect me as I am worried that I might be out of visa status from 12/21/2009 to 01/01/2010.
Please suggest. I need to make a decision in few day.
Would greatly appreciate a response.

NYGal if you go to immigration.com then go to forums then Labor certification then Backlog centers the updated site is there in the forums under the title similar to my thread.

Congresswoman Zoe Logfren & & senator John Cornyn are supporters of legal immigration, they have always come forward to help the legal immigrant community. I guess it is high time people from California & Texas write & call to their offices and complaint about USCIS/DOS action of not releazing and statistics on I-485 applications pending invarious categories. We are blind folded by these Visa bulletins with no idea of what there for EB-3, EB-2 India, China etc. we don't know how many people are ahead of us what to do next. All this will resolve it USCIS/DOS tells us how many applications they have pending from which country and which category....For that we need to call these lawmakers..

The storyline continues. Last year, 13,500 regular H-1B applications were counted in the first week and 5,600 advanced degree applications. This year 5,900 regular applications were received in the first week and 4,500 advanced degree petitions. USCIS just reported that in the second week of counting, 7,100 regular cases were receipted and 5,100 advanced degree applications. H1 Company is based in Phoenix with another office in delaware.I have gievn my address from NewHampshire on my LCA and NJ on my I 140 application.I work for a client in Newyork.I have given my address in New hampshire as I was not sure that my project will be for a longterm and gave my cousins address in New Hampshire for LCA.
I got an RFE asking why I have different addresses on my LCA and I140 while my company is based out of Arizona and Delaware.Please suggest how I should be answering this.

I am a July filer and have the option of working for a reputable company as expert consultant for 6 months (initial offer). Yates memo indicates that self-employment is possible. Here is my question: Do we need to register a company to be considered self-employed? As a consultant you may not have a customer for while. Isn't it better to register a company if you want to claim self employment? What are the pros and cons of registering a company?

Guys,
I filed our AP & EAD on August 10th with proof of 485 filing/delivery confirmation.
We got our receipt notices for AP 131 but unfortunately they have rejected our EAD 765 for incorretc filing fee of $180.
They written a notice saying the correct filing fee after July 30th is $340.
But for July VB is'nt the filing fee $180?
I have got back my entire documents packet for 765.
What should I do now? Should I resend the packet with a letter saying that I come under July VB? or should I send a new check for $340? Anybody gone thru similar experiences? Pls help.

I went on March 11. I went in for 10 am appointment and was out at 10.10 am. Fulltime, first time H1B stamping. Simple questions - where did I do my education, what do I do in my current job, then the officer asked for W-2s from last two years and that was it.
