Unless some political goof up turns, economy seems to be getting brighter and brighter. This might help translate into more jobs and opportunities..

The annual Consumer Electronics Show kicks off this week in Las Vegas. This is the gadget wonderland I've attended for the last several years. Due to my father's illness, I decided to skip this year's show. But I'm avidly watching online for announcements of the year's best new innovations. Hello all,
I applied for I485 + I150 in June 2007 under EB3. My I-140 is still pending.
Employer used a preappr labor with PD of May 2005. However, the lawyer gave me only the ETA 750B portion of the labor to fill
Now, from some forum I found out that PERM was started in March 2005 and the form was 9089 to be used for labor after march 2005 filings.
So, how did my employer file my labor using ETA750B part which was applicable for old labors since my PD is May 2005 which is after the PERM?
Lawyer and Employer are not willing to help, hence reaching out.

Do not do this - please stop playing around with USCIS rules. There are sometimes unfortunate circumstances where folks lose status (e.g., OPT -> H1b) or are kept in dark about their H1B status by employers but for folks who break the law in a way that you are suggesting, I believe they should be punished.

Folks, I'm in the current sitation. In 6th year of H1B, aplied for PERM labor pending with ATL processing center for >15 mtonhs. Attorneys are filing for 7th year extension. I need to traval in the next 2 weeks but not confident enough to get everything right, I need my visa stamped aswell, which with the current H1B validity, would be onlyuntil 22nd Oct 2009. I did try to convince my Managers that they file the extension under premium processing and I could get extended visa until Oct 2010, but Attorney advised that it is not necessary and I should be fine to go, get my visa stamped and come back.
2 points I'm concerned about are,
1. Since I have < 6 months validty on current H1B is it safe to travel and I would hopefully have my extsntion reciept number when I go for stamping.
2. Heard lot about denial of entry at POE, I'm trying to avoid certain airports that I has problems (JFK, EWR etc). Not sure I'm doing enough to be safe.
Any advise is greatly appreciated.

Valid AP is enough to travel - no one should care about your EAD if you are entering based on your AP. Ofcourse, always carry a copy of the I-485 and your wife can say that you are the primary applicant if they ask for her work status, etc...
Traveling with an AP (w/o EAD) should not be an issue. Good luck!

I suggest that we all get together to discuss how we can help the effort that immigration voice has undertaken. I did attend an IV meeting in NoVa a few weeks ago, I am keen on pushing an initiative of meeting periodically to discuss how we can collectively help our cause on this side of the river.
Send me an PM to express your interest and I will send out an email with further information.
If the MD state chapter is already having meetings, please ignore this message; but some one please send me the information on when these meetings take place.
Also let me know what you all think of this proposal?

I am July 2nd filer and got EAD approved.
My 485 notice has Received Date as July 19th 2007 and Notice Date as October 17th 2007.

ICE has announced sentencing in two cases related to visa fraud. Houston immigration lawyer Kenneth Rothey has been sentenced to fourteen months in prison for money laundering and visa fraud. Rothey was convicted for his role in securing L-1 visas based on manufactured corporate relationships. I came to US with H1 on Apr 2009. My wife who was working in the same company as I do, joined me on Dec 2009 with H4 visa. My H1 has expired on June 18 '10. I have applied for H1 extension much before and currently my status is pending with USCIS. Along with my H1 extension I have also applied for my wife's H4 extension. Her status is also pending.
My company has actually filed H1 visa for my wife for 2011 H1B quota.
I have the following questions, can someone kindly answer the same.
i) If my wife gets her H1 petition approved, should she travel back to my country to get it stamped and for her to work here in US?
Some say she should go back and some say she can start working here with her I797 notice, she can get it stamped whenever she goes to my country. Which is true?
ii) Assuming I get approval for my H1 extension and her H4 extension, should she get H4 extension stamped as well?
iii) Can she go for stamping for H1 as well as H4 in my country, if so which one should she go for first?
