Hi All,

How important is the location of the US embassy for getting the H1B visa stamping ? When applying for my H1B petition in April 2008, my lawyer had mentioned that I would be going to the US embassy in Germany for the H1B visa interview. I'm also aware that I could go to my home country for doing the same. However, does anyone know if I can go to Canada/Mexico, given that I have the visas to go to these countries ? I have a US H4 visa.

Hello Gurus ,
I am looking for H1 Transfer with 4 months left in H1 six year limit .I lost my job 10 days back.I have approved I-140 but its has not been six months yet after approval .I have not yet filed 485 .

Will I qualify for 3 year H1 extension based on my approved I-140 .?

Hi

I'm currently working on L1B visa from company A. My present employer applied H1B visa also for me and it got approved around in the August last year. Now I'm planning to change my visa status to H1B.

So I would like to know the options that I have to get my visa status changed to H1b.


1) Can I transfer my H1B to some other company now as my H1B already approved? Is it possible?
If it is, how can I change my status?

2) What is the procedure if I have my current employer do my visa status changed to H1B? Do I need to leave US and come back to take that effect?


Please kindly reply to my questions.

Hi Forum,

My wife has an H1B visa which has been invalidated now because she had to travel to US with me on H4. Her petition seem to be valid. The I94 in her passport has H4 mentioned on it. Now we want to convert her visa back to H1. Since she has H1, I am wondering the H4 to H1 conversion process should be easier compare to applying fresh H1.

It would be great if you guys let me know what is the process of converting this without going back to home country.

If we lose our job after having the I-485 pending for more than 8 months, I-140 approved, how much time do we have to find another job?

Do we have to immediately withdraw the petition after losing/quiting a job?

WILL COMPLETION OF MY M.S. IN 1 YEAR BECOME A PROBLEM FOR GETTING A H-1B IN THE MASTERS (M.S.) QUOTA OF 20,000?

BCOZ SOME OF MY FRIENDS TOLD ME THAT IT IS NOT GUD TO COMPLETE M.S. WITHIN 1 YEAR OR IN EXACTLY 1 YEAR, LATER IT BECOMES A PROBLEM FOR GETTING A H-1B THROUGH M.S. QUOTA.( THEY SAID THEN I WILL HAVE TO GO THROUGH GENERAL 65,000 QUOTA AND WILL NOT BE ELIGIBLE FOR 20,000 M.S. QUOTA, if m.s. is completed in 1 year)

IS IT TRUE, IS THERE ANY SUCH IMIGRATION RULE DURING H-1B FILING

Folks,

Pretty soon I'll have to relocate to another city (same job). Wondering if I should continue using my H1B (valid till 2010) or should I use AC-21 to relocate ?

My attorney insists that I use AC-21, and she states that if something goes south during my Adjustment of Status I can re-file for my H1 and she did state the refiling H1 will be exempt from Annual Numerical Limits as I have been on Non-Immigrant visa in the past 6 year and haven't stayed outside the country for over an year.

Is this something I can rely on? Also, what happens to pending AOS(485) if I use this option to refile my H1 from EAD status?

My law firm has said they will receive FP notices and then they will forward it to me. I got my AP & EAD in mail directly from USCIS.

I see thread for all other years (2003, 2004, 2005, 2006 and 2007). So its my turn to open thread for my year.

Mine is EB2, Feb 2002. Still waiting. I was told that my NC is cleared.

3 SR, 2 letters to Ombudsman, letters to 3 senators, letters to 2 representatives, 2 fax to NSC, 2 letters to NSC Director, 1 infopass, numerous calls to NSC

Recently sent a letter to first lady. Looks like all of them are working together. Nobody wanted to respond.

Please feel free to write your experience if you are 2002 filer.

In case, if we dont have a birth certificate, I understand we need to submit 2 affidavits and NA certificate from the place where we were born.

My question is, do we need them in original or copies will work?

If we need originals, getting them from India takes time...
