    In theory, you don't have to be in the US for any part of the permanent residence (PR)process. A company could do a labor cert and I-140 for you, and then you could complete the PR by interview at a consulate, and only then start working for the US employer. In practice, of course, that never happens. However, it is possible so that you can safely go to India.

    Hi folks,

    I've applied for I 140 at TSC and my reciept date is Dec. 15, 2007 Under EB1,

    Can i apply for I 485 while my I 140 is pending or should i wait for the approval first.

    Illegal non-immigrants did the rally to local USCIS offices. It would be good if we pick one day in 2nd week of July and have a rally to local USCIS offices. This will immediately catch the media attention.

    Rally news should be spread out to media so we can get enough coverage?

    Hi,

    I would like to apply for the H1B Visa. For the same, I would like to clarify whether I am eligible with the following education background (Basically I am looking for the 16Yrs education criteria)

    1) Did schooling up to 10th (10 Yrs)
    2) Did Diploma (3 Yrs, Full Time)
    3) Total IT work experience is 9.10 Yrs
    4) Did B.S ( Bachelor of Science -- 3Yrs - Work Integrated Course/Distance Edu)
    5) Did M.S (Master of Science -- 2Yrs - Work Integrated Course/Distance Edu)

    Hello

    Am currently on F1 - OPT status (stem OPT). Been working as a volunteer intern for past few months. Currently one of start-up company is interested in hiring me but they do not have a legal department and also not enough resources to apply for H1B. I offered to pay for my H1B fees, but they have no idea how to go about this.
    Can anyone please tell how do i go about this? What kind of lawyer should i approach , what information will i need from the company, how much money does all this involve.
    The other option is start working for this company , get H1 done through a consultant and transfer the H1b, again this involves legal dept which neither me nor the company has any idea. Please advise .
    My OPT is valid until Dec 2011.

    I had applied on July 19th to Nebraska. My I-140 was approved from TX.
    Today I received transfer notice WAC...., mentioning that they have transferred my case to TX Service center.

    The receipt date is of Sep 14th, Notice date of Sep 17th'2007.

    Does it mean I lost the original filing receipt date of July 20th'2007.

    I have filed for 485 /EAD and AP on july 2 2007
    receipt date is July 2 2007
    Notice date is Aug 29 2007

    I see the processing time is 90 day at Texas
    I called USCIS and they tell me that they count processing time from the Notice date and not from the date when the case was filed

    We have travel plans for this Dec

    Can some one pls guide me how and when i can get my AP soon

    Hi Friends,

    I work for a big 4 consulting firm and transferring my H1-B to a client (a 2 Billion dollar american company).......I'm planning to join my new company only after the visa has been transferred ........my questions are:

    1.) If the transfer is rejected, can I work for my current employer (assuming I dont resign)

    2.) My wife's on H4 and recently applied for COS from H4 to F1 - Do I need to file for her H4 transfer also or not?

    Not sure what's the effect of H1 transfer on wife's pending H4 to F1 application.

    Need help ASAP. Thanks a lot.

    Hi,

    I have an EB2 I-140 approved with priority date of July 2006, but also recently got EB3 I-140 approved with priority date of May 2003.

    Even though the dates are current, but it may retrograte in coming months, so Can I file I-485 using my approved EB2 with the priority date of EB3.

    Please advice.
