Company A has file for H1B and it got stamped. I came to USA last week and did not join them (Company A) as they were not able to provide me job and were asking me to delay my trip to USA. Now last week monday they (Company A) said they will terminate my visa and will report to USCIS. My new employer has yet not applied for H1B transfer. So i wanted to know how much time do i have left to do it (H1B Trasfer). Suppose Company A filed for visa cancellation on 11th June, Monday. Please let me know if there would be any problem in filing for H1B transfer now as Company A has filed for cancellation before I file for H1B Transfer.
I would appreciate a detiled reply.

I have applied for AOS/EAD/AP. I am moving to a new address soon. Will the recipt and EAD/AP be sent to me Old address? I am worried that they may get lost.

Guys,
I need to find out what documents I need to send after I file I-765 online. DO anyone has the experience in this matter. I filed my I-485 and at tht time i did not filed my I756 just to avoid lawyer's fee.
The form says I need to send a copy of I-94 and photo thats all, but the confirmation notice I received after filing the form online said that do not send any photo's or any identification document and the notice said that they will sent me a Biometric appointment.
DO anyone has info on this

I'm a little confused about my options in starting my H1 extension process and applying for my wife's H4 application.
Here is my current status :
6 yr H1-B period is ending on Dec 22, 2009. I'm getting married in India in October and will apply for my wife's H4 immediately after. Here are my questions :
1. Will there be any problem with my wife's H4 application if there are just 2 months of validity left on my H1 visa?
2. I could potentially start my H1 extension process now. I'm eligible for a 3 year extension since the Priority date of Jan 3, 2006, on my EB2 application is not current. If I was to start my extension process now, my approval may not happen before October and my lawyer there may be some problems if I travel outside the country on a pending H1 application. Should I apply for my H1 extension now or after I come back to the US in November?
3. If I was to apply for H1 extension in Nov and don't get an approval by the time of my current H1 expiry in December, will I be out of status?

There is no mandate about that....They can come back anytime before Aug 17 as long as their PD is on or before July 31st, 2007.....Since USCIS said it will not reject 485s without medicals, you can get the medicals done later and submit when they send you an RFE....However, make sure to keep all the applications filled in and ready for mailing except for the signatures and I-94 information of the returning individuals......

One can contiue to stay using I-485 receipt without valid I-94. afasik I-797 can be used only if you filed H1 extention after you came back on parolee.
If a person travels on AP, he will get a new PAROLE I-94 which shows expiry date of 1 year from the day he entered on AP. Can the person stay in US AFTER that expiry date and continue working using a valid I-797?

The child of an H-1B is eligible for an H-4 (as long as parent remains an H-1B) up until their 21st birthday as long as they remain unmarried.
