My company recently moved offices to a new location just a few miles from the old location. Its in an adjacent county but with in the same state. We moved from Northbrook, IL to Deerfield IL, does this warrant a change in LCA/H1B?

Please advise.

Most attorneys have historically advised to file ammendment to LCA in case of address change like this. Provided that job conditions same, (which is likely in your case as it is just a few miles away) ammendment should be easy.

Hi,

Some where in May I heard the news that end of this year USCIS is going to halt concurrent filing of I-140 and I485 and introduce an extra step called preApp of I485 which can be done only after an I40 approval. I would like to know if this is really going to happen?

I have an approved I140 and a PD of Apr 08. I am planning to change the company now. My doubts are
1) Suppose if USCIS changes rules and introduce an extra step for preapp of I485.
What will happen if I switch company after 180 days of preapp of 485. can I invoke Ac21 ?
2) will I be eligible for EAD/Parole after preapp of 485?

Any body having any knowledge about this please share.

My wife will be applying for H4 visa (1 st time) some time in march. I am currently working on H1B in US.

while checking the website for documents required for H4, they ask for the Photocopy of the Principal Applicant�s valid visa.

Since I am a canadian citizen, I do not require a visa for US and hence I don't have a H1B visa stamped on my passport.

I would appreciate if you could reply me on this regard.

Though not directly related with immigration, I really think everyone should see this movie and hope they would not get into a mess by some sudden medical emergency and the related medical costs. I guess we are ok as long as we work some big company providing reasonable health coverage. Bench time with the desi firms could be a wrong time to get sick.

Hi All,
We have sent AOS, EAD and AP applications for my wife and me on August 7th. So far, we have received receipt notices for EAD, AP and AOS for my wife only with Notice Date of September 17th. To my surprise the Priority Date field is left blank on all the receipt notices. Just wanted to check with others who have received their spouse's receipt notices if this is usual and nothing to worry about.

There was an I-140 filed but it was denied and I never heard from my petitioner then. I do have the USCIS copy and case number. Can I look for another employer and atty that could reopen the case?? Company A applied for labor(EB2) in Dec2006. It was approved.
My I140 was filed in March 2007 and approved on Jan 10 2008.
I did not file for I485 in July 2007.

I had changed companies in April 2007.Presenly I am on Company B payroll.

Now, If I move back to Company A, would I be able to apply for my I485 when the date opens.
The online status for I140 says, Approved.
I am in good terms with both the employers.

If I move to company A; at the time of applying I485, do I need to have paystubs from Company A?

Please help. Thanks

Friends, Please let me know your input-
Here is my backgound -

1.Current status working on H1B 8th year extension for company A
2.Labor and I-140 is approved � EB3 PD 04/2006 - Company A
3.485 pending applied in August 2007 (> 180 days) - Company A
4.EAD & AP approved - Company A
5.Wife on H4 Status not filed for her 485 as she was not here.

I want do H1b transfer & work for another company B -(Job code & job duties are little different)
I don't want to use AC21 - just continue with Company B on H1 B transfer.
I am doing H1b transfer nothing else once dates are current will add my wife.

Am I doing something wrong or screwing up my GC process?
Please advise

Hey guys, I was wondering what program you guys use to view RAW files from your Sony (Alpha 200 in my case)?

I am particularly interested in a viewer where I can scroll throw a folder of images quickly full scree, using the arrow keys on the keyboard, possibly with an option to zoom in 100% and also possibly where I can easily delete the image with a press of the Delete button. My PERM was filed in Dec, 2006 and was denied on April, 2007. As per my employer's lawyer it was erroneously denied by DOL. The lawer has received the denial letter but no reason was stated. He was keep on follwing up with DOL but no answers. On Aug 2007, lawyer was followed up again directly with the DOL office in Atlanta , with the liaison at the American Immigration Lawyer's Association and also it was sent to the congressional office. Through Senetor we came to know that there was typo in the date field. The lawer is persuing to get the denal letter again with reason so that we can appeal. But we have 10% chance to get the another deial letter. Now lawer is asking for filling a new PERM. In between I lost 8 months and now I'm running out time. My 6th year is expiring on Sept08. Just incase if we din't get denial letter and file the new PERM on Mrach can we get the 7th year extension ? (We will show all the documents etc for previos denail case and there was no reason in denail letter. PLEASE HELP

I have an approved labor, H1 Visa stamp still valid 2.5 years more. I will be applying for I140/485 once this debacle settles.

Can any one tell me, what are the consequences of leaving the US for a weeks vacation in India, while the application is in progress? Some say it is abandoning the application.....Would anyone know

Also, my wife is now on a B1. When I add her name to the 140/485 and she comes back as an H4, will it cause issues

Hello Friends,

I have a question regarding waiver on J2 EAD.
My husband is doing residency on J1 since last 9 months. His residency program is of 4years and plans to do 1 yr fellowship later on on J1 so total of 5 yrs
I m now on J2 and have an EAD with me.
My questions are:

1. Do I need to do a waiver job after I complete my residency on EAD before joining any other hospital here in the US? or it just applies to my husband(on J1) to do a waiver.

2. If aftercompleting my residency on EAD, if my husband gets a waiver he will be on H1 and me on H4and if the same year I get H1 fellowship program for 1 yr, can I change my status from J2 EAD to H1 without doing a waiver?

3. How much time it normally takes to renew your EAD?

I changed my employer 3 months back and didn't expect the dates to get current so soon. My labor with the new employer has just been filed. However, my previous employer told me that if I want to continue with my gc process with them, I need to be their employee again.
Does it make sense for me to do this ? My 485 will not get filed until 10 days from now because I have yet to start with the paperwork.

I have been cheated by a desi consulting company e-Data experts located in Harrisburg, PA. They applied for my labor in December of 2007 and it was audited and finally I was told in June 2010 that it was denied. Actually it was denied in January 2010 but they did not reveal this information intentionally. Now I am in my 6th year of my H1b which expires in March 2011. My EAD and AP have the wrong birth date and I just noticed it. I have to re-send form I-765 and I-131 with the original EAD and original AP for correction. My case was originally filed in NSC along with 485, but I live in Texas.

But, as per instructions for I-765 and I-131, form should be filed at:

"Service Center with jurisdiction over your residence or Local Office - depending on where your case is pending."

Can someone guide me please ? Where should I file - TSC of NSC ?

Forget about justice. There is only business. The logic is very simple:

Current Situation: You target some perceived very deep pockets customers and try to sell yourself to them, but now you realize that they are just some idiots;

For what it's worth, I was a Nikon pro card carrier back in the '70's. It was a FABULOUS service. I was allowed to borrow expensive gear for free that I would never have used otherwise (e.g. radio-remote release, medical telephoto with built-in ring flash, nikonos)

And the "go the head of the line" repair service saved me more than once. While I was vacationing in California I needed some urgent repairs and was told by the local main Nikon repair shop that their backlog even for "urgent" repairs was 3 months. I flashed my pro card and it was in the repair shop by 10:00 and out by noon!
